Mesh Patch Lawsuit

For patients who suffer from ventral hernias, hernias caused when scar tissue from a previous surgery thins or stretches, some doctors have long recommended repairing the weakened area with a mesh patch that is implanted behind the patient’s hernia. In order to insert the patch in through a very small incision, the patch itself is normally held open by a coiled ring. This way the patch can be inserted while it is all folded up and then the ring can be sprung open so that the mesh patch will lay flat once it is in place. In theory, it sounds like a minor repair, but structural problems with the coiled rings have led to multiple recalls and lawsuit after lawsuit from patients who have suffered intestinal fistulae, bowel perforations, and injury to other internal organs.

On overarching issue that has left the mesh patch particularly vulnerable to a lawsuit is the fact that the manufacturer continued to market the device and doctors continued to implant it even after multiple recalls from the FDA. After initial reports of the problems with the coiled ring began to accumulate, the FDA issued a recall of certain lot numbers of the mesh patch. They also warned surgeons and hospitals to stop using any of those lot numbers and to return unused mesh patch units to the manufacturer. Any patient that had a mesh patch with the recalled lot numbers was encouraged to seek medical attention, especially if they had persistent abdominal pain, tenderness at the site where the mesh was implanted, fever, or any other unusual symptoms.

Following that initial recall by the FDA, however, several mesh patch lot numbers were added in multiple expansions of the initial recall list. Eventually all lot numbers for the large circle, large oval, and extra large oval mesh patch rings that were made before 2005 were included in the recall list. What is amazing, however, is that even after the initial recall, and knowing that issues existed with the ring, the manufacturer continued to use it in other forms and sizes of the mesh patch and doctors continued to implant them.

If you have had a mesh patch implanted and are experiencing medical complications, you should seek medical attention as soon as possible. You should also to consult with an attorney to determine if a lawsuit is in order. Your attorney will be able to let you know if your mesh patch was among those recalled and will offer you legal counsel regarding the best steps to take toward gaining justice and restitution.
